Consider an example.<\/p>\n\n\n\n

0061 Crooked lawyers love the sin of omission<\/em>.  They love to omit the evidence that would cause them to lose the case<\/em>.  This love is justified by the doctrine of total satisfaction for the client<\/em>.  The crooked lawyer does not serve justice.  The crooked lawyer serves only his client, even when his client is guilty as charged.<\/p>\n\n\n\n

In the domain of morals, the doctrine of total client satisfaction<\/em> stands in opposition to an oath to serve justice<\/em>.  Lawyers take an oath to serve justice.  This doctrine deprives the oath of its merit.  Evil is a privation of good.<\/p>\n\n\n\n

Legal theory<\/em> contextualizes a lawyer\u2019s cupidity<\/em>, even as the lawyer\u2019s exploits<\/em> defy the attainment of justice<\/em>.<\/p>\n\n\n\n

0061 Is there a hierarchy here?<\/p>\n\n\n\n

Crime is what happened3a<\/sub><\/em>.  A trial is what is happening3a<\/sub><\/em>.  Victory in court is what it means to me3b<\/sub><\/em>.  Someone really depraved<\/em> constructs the legal process that permits it all3c<\/sub><\/em>.<\/p>\n\n\n\n

There is a hierarchical difference between a corrupt lawyer3b<\/sub>,<\/em> who objectifies what is happening3a<\/sub><\/em> in the pursuit of total victory for his client1a<\/sub><\/em>, and a legal theorist3c<\/sub><\/em>, who formulates the consensus of what is legally permissible1c<\/sub><\/em>.  Legal theorists3c<\/sub> fashion suprasubjective entities, concocting law-determining judgments2c<\/sub> that alter, tweak, nudge, correct and re-configure the intersubjectivity2b<\/sub> within which a moral agent3b<\/sub> signifies<\/em>.  Legal theorists3c<\/sub> alter the machinery of justice2c<\/sub>.  Evil ex academia1c<\/sub><\/em>.<\/p>\n\n\n\n

The well-educated cutting-edge legal theorist3c<\/sub> offers norms2c<\/sub> that may oppose the rule of reason and the divine law1c<\/sub>, just as parody opposes tragedy.  The projection of alternate meaning<\/em> into words1c<\/sub>, such as \u201cclient interests\u201d, \u201cservice\u201d, “mandates” and so on, mocks the hard-won projection of true meaning1c<\/sub>,<\/em> where the client\u2019s interests do not outweigh justice and true justice ultimately furthers the interests of us all, including the client.<\/p>\n\n\n\n
